Three decisions the document forces you to make

What the price actually covers

Line items grouped by section make scope visible instead of implied. A client reading six sections understands they are buying six pieces of work, and an allowance with a stated dollar figure tells them exactly where their own selections start costing money. State on the face of it whether this is a fixed price, sometimes written as lump sum, or T&M at named hourly rates, because a dispute reads the two completely differently.

What it does not cover

Exclusions are the section contractors skip and then pay for. Name hazardous material abatement, unforeseen structural or rot repair, engineering fees, permit and impact fees if you are not carrying them, utility upgrades, landscape restoration and appliance supply. Also state who pulls permits and who carries the impact fees. If the client can read the document and still be surprised by a charge, it is incomplete.

How long the price holds

An estimate with no expiration date is an open offer. Owners sit on numbers for months and then ask you to honor pricing your supplier withdrew in the spring. Set a valid-until date on the document, state plainly that pricing is subject to re-quote after it, and name the change order process in writing so extra work never starts on a jobsite conversation and every addition arrives priced and signed.

An estimate and a proposal are not the same document. An estimate is a non-binding range. A quote or bid is a firm offer that becomes a contract when the client signs it. If your number is firm, label the document a proposal, put payment terms and an expiration on it, and treat it as the contract it will be read as. The word on the header will not save you if the substance says otherwise.

What the law puts on the page, and what it caps

Down payment law, mandatory notices and cancellation rights are set state by state, and the omissions are what suspend licenses. These four are confirmed against primary sources. Yours may differ, and most states that are quoted in deposit tables online have no statute behind the number.

Deposit and down payment caps

California limits the down payment on a home improvement contract to $1,000 or 10 percent of the contract amount, whichever is less, unless you furnish a performance and payment bond or approved joint control (Cal. Bus. & Prof. Code § 7159.5). Maryland caps the deposit at one third of the contract price and bars any payment at all before the contract is signed (Md. Code, Bus. Reg. § 8-617).

Florida has no cap, but 10 percent is a trigger

A contractor taking initial payment over 10 percent of the contract price on residential work must apply for permits within 30 days of that payment and start work within 90 days of permit issuance (Fla. Stat. § 489.126). Failure carries criminal penalties that escalate with the amount received, from a first-degree misdemeanor under $1,000 to a first-degree felony at $200,000 and above.

The lien warning is a formatting requirement

Florida requires a construction lien notice in no less than 12-point capitalized boldfaced type in any direct contract with an owner over $2,500 on residential property of up to four units, signed and dated by the owner (Fla. Stat. § 713.015). Owners who are licensed under chapter 489 are exempt. Mechanic's lien rights and any lien waiver you later sign both begin with this document.

Three business days to cancel, if you sold at the house

The FTC Cooling-Off Rule gives buyers until midnight of the third business day to cancel a sale of $25 or more made at their residence, or $130 or more at a temporary location such as a hotel room or fairground. You must furnish the Notice of Cancellation in duplicate, print the cancellation statement in at least 10-point bold type and say it out loud at signing (16 CFR Part 429).

This is not legal advice, and this tool does not give any. The generator formats a business document; it does not check your state's requirements. Have a construction attorney licensed in your state review your estimate and contract language before you use it, particularly the deposit, change order, payment and cancellation clauses. Statutes change, and a document that was compliant three years ago may not be now.

Statutes read at their primary source and current as of 11 September 2026. We publish no deposit-limit table by state, because the ones circulating online cite no statute and several of the figures in them cannot be traced to any published text. Georgia in particular has no state deposit cap that could be found.

Estimates, proposals and deposits

Estimate vs proposal vs quote vs bid: what am I actually sending?

An estimate is a non-binding price range; a quote or bid is a firm offer that becomes a contract when signed. The words carry real consequence, because a document labeled estimate that the client signs and you both perform under can still be argued as a contract. If the number is firm, label it a proposal, put an expiration on it and state your payment terms; the construction bid proposal generator builds that version, with exclusions and alternates.

Should I charge for estimates?

Charge for the takeoff, not for showing up. A free site visit and a ballpark range filter tire-kickers cheaply. A detailed scope with selections, subcontractor quotes and a line item breakdown is billable pre-construction work, and crediting the fee against the contract if they sign removes the objection. Contractors who charge flat for every estimate report losing volume; those who charge for detailed scoping report better close rates.

What is missing from most estimates?

Exclusions, not pricing. What to include in a construction estimate is settled once you accept that: a defensible document names scope of work by section, what is specifically excluded, allowances with dollar amounts and what happens on overage, a payment schedule tied to milestones, the change order process in writing, an expiration date, your license number and who pulls permits. If the client can read it and still be surprised by a charge, the document is incomplete.

How much deposit can a contractor ask for?

It depends on the state, and several cap it by statute. California limits the down payment on a home improvement contract to $1,000 or 10 percent of the contract amount, whichever is less, with an exception for bonded contractors (Cal. Bus. & Prof. Code § 7159.5). Maryland caps it at one third of the contract price (Md. Code, Bus. Reg. § 8-617). Does the client get three days to cancel?

If you sold it at their home, yes. The FTC Cooling-Off Rule gives buyers until midnight of the third business day to cancel sales of $25 or more made at the buyer's residence, or $130 or more at a temporary seller location, and requires you to furnish the cancellation notice in duplicate (16 CFR Part 429). Several states layer their own rescission rules on top. A contract signed at your office is generally outside the federal rule.

Should the deposit and progress payments be percentages or milestones?

Tie them to milestones and state the percentage next to each. A construction payment schedule reading deposit to schedule, rough-in complete, substantial completion and final payment on punch list gives both sides an event to point at, and it keeps your billing ahead of your cost instead of behind it. Retainage held past final completion should be named in the document rather than assumed, because on private residential work no statute sets it for you.

A better estimate closes more of the jobs you already quoted

It does nothing about the ones that never called. If you are writing solid documents and still not booked out, the gap is upstream of the estimate.
